RE: Rejection of All Bids for ITB#2019/2020-A08
On December 15, 2021, Clay County Utility Authority (CCUA) received two (2) bid responses
for ITB# 2019/2020-A08 entitled Spencer's Crossing Wastewater Treatment Facility (WWTF)
Clarifier No. 1 Foundation Stabilization. The responses were from Consel Construction
Specialty Services, Inc., and PBM Constructors Inc. All CCUA solicitations require each
responder to complete the Non-Collusion Affidavit to ensure fairness in the competitive bidding
process.
After reviewing both bid responses, staff found that each Prime Contractor used the other
Contractor as a Subcontractor. CCUA Enabling Legislation and public procurement policies
encourages competitive bidding without collusion. The fact each Contractor is listed as a
subcontractor for the other does not give the appearance of a competitive bid submittal.

= Therefore, staff recommends the Board of Supervisors reject the two bid responses based upon a
z non-competitive bid.

ARTICLE 19—EVALUATION OF BIDS AND AWARD OF CONTRACT
19.01 Owner reserves the right to reject any or all Bids, including without limitation, incomplete,
irregular, not in conformance with the specifications, invitation, or Instructions to Bidders,
nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves
the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and
evaluation, to not be responsible or the Bidder is behind by 10 percent or more on
completing an approved progress schedule for the Owner at the time of advertising the
work. A Bid may be found to be irregular or non-responsive by reasons that include,
but are not limited to, failure to utilize or complete the prescribed forms, modifying
the Bid specifications, submitting conditional Bids, incomplete Bids, submitting
indefinite or ambiguous Bids, executing forms or the Bid sheet with improper and/or
undated signatures or failure to provide all required information. Other conditions which
may cause rejection of the Bids include, evidence of collusion among Bidders, obvious
lack of experience or expertise, and failure to perform or meet financial obligations on
previous agreements. Owner may also reject the Bid of any Bidder if Owner believes
that it would not be in the best interest of the Project to make an award to that Bidder.
Owner also reserves the right to waive all informalities not involving price, time, or
changes in the Work and to negotiate contract terms with the Successful Bidder.

The undersigned being first duly sworn as provided by law, deposes,and says:
1. This Affidavit is made with the knowledge and intent that it is to be filed with the Clay County
Utility Authority,Clay County,Florida and that it will be relied upon by said County,in any
consideration which may give to and any action which it may take with respect to this Bid.
2. The undersigned is authorized to make this Affidavit on behalf of
Consel Construction Specialty Services Inc.

or person,firm or corporation,to put in a sham Bid,or that such other person,firm or
corporation,shall refrain from bidding,and has not in any manner,directly or indirectly, sought
by agreement or collusion,or communication or conference with any person, firm or corporation,
to fix the prices of said proposal or proposals of any other bidder;and all statements contained in
the proposal or proposals described above are true;and further,neither the undersigned,nor the
person, firm or corporation named above in Paragraph 3,has directly or indirectly submitted said
proposal or the contents thereof,or divulged information or data relative thereto,to any
