January 18, 2022 Diane Branaugh Villages of Fireside Homeowner Association 2504 Moon Harbor Way Middleburg, FL 32068 RE: Drainage Concerns Dear Ms. Branaugh, As you are aware, Clay County Utility Authority (CCUA) has been working with the Villages of Fireside regarding a potential drainage issue. The CCUA Executive Director met with you and other residents on Wednesday, January 6, 2021. The drainage issue appeared to be along the property boundary of CCUA's Ridaught Landing Water Reclamation Facility(WRF)and residential lots.Due to the amount of vegetative growth, fencing, trees, and debris that have accumulated over the years, staff could not determine if the c drainage issue was a CCUA maintenance issue or a Homeowner Association (HOA) issue. a; To adequately evaluate the drainage issue, staff engaged a surveying and mapping company to prepare a topographic survey of the area. Based on review of this survey,the elevations show the designed drainage flow pattern from west to o east in the easement. CCUA constructed the WRF berm prior to development of the residential lots. The original construction drawings for the subdivision indicate the drainage easement along the back of the residential lots was intended to drain the area. CCUA's understanding is further supported by the drainage easement recorded in the subdivision plat. Since the HOA is responsible for maintaining flow in the ditch per the SJRWMD permit, CCUA does not have jurisdiction on any upkeep in the area. You mentioned the HOA is mandating the homeowners move their fences if encroaching into the drainage ditch. Hopefully that step, as well as routine community maintenance, will alleviate the community's issue. CCUA appreciates our continued discussions.
