EXECUTIVE SUMMARY AGENDA ITEM: Change Order No. 2 to Agreement with CDM Smith Inc. (CDM) for the Meadow Lake Water Treatment Plant (WTP) Expansion 2018/2019 RFQ No. 6 to provide limited Resident Project Representative (RPR) services during construction. Date: January 18, 2022 BACKGROUND: The Meadow Lake WTP expansion project provides additional water service capacity in the rapidly growing Lake Asbury service area. The Board of Supervisors awarded the design of the facility to CDM on October 20, 2020. The construction of the project was awarded to R2T, Inc., on November 2, 2021. The construction project duration, from the Contractor's Notice to Proceed (NTP) to Substantial Completion is anticipated to be ten (10) months ending in October 2022. During the construction period es RPR services are required to monitor and report on the construction activities to ensure that the equipment, a workmanship and the project is completed in accordance with contract document specifications. a; ca o At the time of initial design,RPR services were not included in CDM's scope. Once design was complete E and the estimate of the construction duration was established, staff requested a proposal for RPR services from CDM-Smith. CDM-Smith is able to economically provide these RPR services throughout the ce construction duration as described in the attached Change Order#2. The proposed Change order cost of $30,742.00 is comparable to the RPR costs on the Mid-Clay Water Reclamation Facility (WRF) and represents approximately 1 percent of the awarded construction cost. BUDGET: The Meadow Lake WTP Expansion Funds allocated to-date for design and construction are $368,093 and $2,720,000,respectfully,which exceeds the project's original capital budget of$2,809,697. Funds for this authorization will come from capital budget reserves. RECOMMENDATION: Staff respectfully recommends the Board of Supervisors' approval of Change Order No.2 with CDM to provide limited resident project representation throughout the duration of the construction project for the lump sum amount of$30,742.00. (CONSULTANT), dated October 21, 2020, hereafter referred to as the Contract. BACKGROUND CONSULTANT provided design and bidding services for the Meadow Lakes WTP Expansion project (Project). OWNER has requested CONSULTANT to provide resident project representative (RPR) services during construction,which is anticipated to take 12 months from the Contractor's Notice to Proceed (NTP)to Substantial Completion. SCOPE OF SERVICES The following tasks describe the part-time RPR scope of services to be provided throughout the duration to of construction of the Project. TASK 1—LIMITED RESIDENT PROJECT REPRESENTATIVE SERVICES DURING CONSTRUCTION This task describes a part-time RPR (budgeted a total of 179 labor-hours) over a 10-month construction period and 1-2 month substantial completion period to assist OWNER in monitoring the progress and quality of the work of the Contractor and confirm that punchlist items are completed following substantial completion. Project representation shall be on a part-time basis and is intended to be at a sufficient level to monitor the Contractor's work and confirm that the Contractor is meeting the requirements of the Contract Documents. CONSULTANT will notify OWNER promptly if above level of field representation is insufficient to monitor the work as defined by the OWNER. RPR will be responsible for uploading the documentation of services described herein to the OWNER document management system or to CONSULTANT's Secure File Transfer system for download by OWNER. The duties and responsibilities of the RPR are described as applicable during the 12-month period as follows: Conferences and Meetings: ■ RPR will attend up to 9 meetings, such as progress meetings (in-person or virtual), weekly site meetings, and other project-related meetings. RPR will provide an overview of meeting minutes to the CONSULTANT'S Project Manager for the project file as requested by the CONSULTANT'S Project Manager. Shop Drawings and Samples: ■ RPR will advise CONSULTANT and Contractor of the commencement of the work requiring a Shop Drawing or Sample, if the submittal has not already been approved by CONSULTANT. Review of Work, Rejection of Defective Work, Inspections, and Tests: ■ RPR will monitor the work in progress to assist CONSULTANT in verifying that the work is proceeding in accordance with the Contract Documents. ■ RPR will report to CONSULTANT and OWNER whenever RPR believes that the work will not produce a completed Project that conforms to the Contract Documents, or will prejudice the integrity of the design concept of the completed Project as a functioning whole as indicated in the Contract Documents, has been damaged, or is deficient; and advise CONSULTANT of work that the RPR believes should be corrected or rejected or should be uncovered for observation, or requires special testing, inspection, or approval. ■ RPR will accompany visiting inspectors representing public or other agencies having jurisdiction over the Project, record the results of these inspections, and report to CONSULTANT and OWNER. ■ RPR will coordinate and review the results of tests made by the independent soils and materials testing laboratory. to Reports and Records: ■ RPR will prepare a daily report with progress photos (during visiting field days), keep a diary or logbook, recording Contractor's hours on the job site,weather conditions, data relative to questions of Work Change Directives, Change Orders or changed conditions, list of job site visitors, daily activities, decisions, observations in general, and specific observations in more detail as in the case of observing test procedures. Copies of reports will be provided to CONSULTANT and OWNER for the project file. ■ RPR will record names, addresses, and telephone numbers of the Contractor's personnel and major suppliers of materials and equipment. ■ RPR will notify CONSULTANT and OWNER in advance of scheduled major tests, inspection, or start of important phases of the Work, and provide documentation of the events, consisting of but not limited to: • Results of field density testing within the footprint of proposed structures. • Yard piping installation including backfill, compaction,flushing, pressure testing, and disinfection. • Reinforcing, formwork, and pour-in-place concrete for structures. • Prestressed concrete tank construction and testing. • Activities that require bypass or Maintenance of Plant Operations (MOPO) planning. • Inspection of proper installation of equipment per manufacturer requirements. • Equipment start-up and testing. • Performance testing and additional testing as required by the Contract Documents. • Electrical and Instrumentation modifications that require MOPO planning and testing upon completion. • Substantial completion and final completion walkthroughs. ■ RPR will report immediately to CONSULTANT and OWNER the occurrence of any accident. TASK 2—PROJECT AND QUALITY MANAGEMENT CONSULTANT will provide monthly invoices that summarize work completed to date, as well as manage schedule and budget for the services provided.This will include internal progress meetings and preparation of project documentation to be provided to the OWNER. ASSUMPTIONS The following assumptions have been used to develop this scope of work and the associated budget: ■ CONSULTANT assumes that during construction, some weeks may not require RPR time on-site, and other weeks may require more than 12 hours/week for on-site services. CONSULTANT anticipates and assumes a maximum of 179 hours (approximately 22 8-hr days)total for a Senior Field Tech broken down as follows: • 9 hours for construction meetings over the 12 month construction schedule (RPR attendance) to • CONSULTANT Project Manager meeting time is not budgeted under this change order • 130 hours for field inspections and reports • 40 hours for equipment start-up, MOPO coordination,testing, substantial and final walkthroughs ■ RPR will be required to be on-site during normal working hours (8am-5pm, Monday—Friday). No night pours are assumed for this project given the residential nature of the plant site. CONSULTANT reserves the right to seek additional compensation for additional services required beyond normal working hours. ■ Other Direct Costs (ODCs) are for the RPR travel expenses (consisting of, but not limited to hotels, food, and mileage)for the part-time RPR services during the 12-month construction period. ODCs are based on RPR being on-site ■ The target 179 hours presented in this scope for RPR services assume field activities, equipment installation and commissioning is completed in a timely and efficient manner to prevent excessive inspection or re-inspection time. CONSULTANT shall provide OWNER with percent completion of hours scoped (regardless of percent construction completed by Contractor) for RPR services monthly.Any additional time beyond the 179 hours for RPR services are subject to additional compensation beyond this authorization as an amendment. ■ Travel time is not included in the RPR billable hours. The CONSULTANT will begin work upon receipt of a NTP from the OWNER dependent on the issuance of the Contractor's NTP. A more detailed schedule will be presented within 30 days after Contractor's NTP. Task Description Time Frame from Contractor's NTP Task 1 RPR Services During Construction 12 months Task 2 Project and Quality Management 12 months COMPENSATION AND PAYMENT to CONSULTANT will complete the work described on a lump sum basis in the amount of$30,742 and as shown in Exhibit A. Invoices will be submitted monthly based on the percentage of work complete during the billing period. Lump sum compensation shall be for labor and other direct costs associated with the performance of the work. For invoice purposes only, the value of each task is as shown in Table 1.
