This past Tuesday, February 22, 2022, the Clay County BCC discussed the potential for a utility tax on
Electric, Gas, and Water services. I attached the Clay County BCC staff presentation. I was asked if we
could identify the typical impact to a customer's bill and presented some basic information to the Clay
County BCC. After discussing the issue,the Clay County BCC decided not to pursue a utility tax.
The attached email I sent to Howard Wanamaker, Clay County Manager, included graphs of residential
water demand representing February (low demand month) and May (high demand month). These graphs
demonstrate the relative impact a 10% utility tax on water demand would have on our customers.
In my presentation to the Clay County BCC,I noted the Clay County Utility Authority(CCUA)contributes
4.5% of gross revenue to the Clay County BCC as a requirement of CCUA's enabling legislation. I noted
to the Clay County BCC that I would recommend to CCUA's Board of Supervisors handling the 10%utility
Aga' tax as a pass-through cost shown directly on a customer's bill. The key statistics below show the related
$ mean and median impact to CCUA customer bills.

I expressed our concern regarding price elasticities on non-essential uses of potable water and especially
reclaimed water. The additional cost to the customer could result in lower revenue than expected due to a
reduction in the quantity of water demanded. I noted this as a risk factor in not knowing the Clay County
BCC's timetable for implementation of the 10% utility tax and the fact this tax was not contemplated in
CCUA's current revenue forecast.
As previously noted, the Clay County BCC decided not to pursue the 10% utility tax after discussing the
issue.

Process and Schedule
• A tax levy must be adopted by ordinance, with the effective date
being January 1st, April 1st, July 1st, or October 1st.
• The Department of Revenue ( DOR) must be notified at least 120 days
before its effective date.
• If County wishes to levy tax beginning October 1, 2022, then DOR must be
notified no later than June 3, 2022, which requires approval of Ordinance

Good morning. I hope you are doing well. I thought Clay Day was a great success.Thank you to the Clay County team for
putting together such a great event.
We completed an initial set of calculations looking at the potential Clay County BCC Utility Tax on water customers. We
looked at months representative of high demand (May) and low demand (February). I used the February and May, 2021,
water demand pattern with our current base and flow charges. I attached the graphs that represent the impact on

customers depending on their water demand. I also included two tables that calculated the tax revenue generated for
those respective months.
In completing this analysis, I think there are a few key points for consideration. I itemized those key points below.
• CCUA customers represent roughly half of Clay County residents. Residents on well and septic systems would be
unaffected by this tax. I think there may be an equity consideration from this perspective.
• We did not evaluate potential conservation effects this county tax may have.The conservation effects reducing
water use would reduce revenue to both CCUA and the County.
o We did not evaluate this potential tax relating to the budget for the current fiscal year. CCUA, like the
county, is facing inflation issues on equipment, material, chemicals, etc. raising expenses. A water utility
tax that would generate a water conservation effect reducing revenue must be considered an unknown
risk factor from CCUA's perspective.
• Potable water demand for human consumption is largely inelastic to price changes due to its nature as a basic
necessity. Potable water used for our outdoor uses(Irrigation)would be much more elastic to changes in cost
(pricing+taxation). Reclaimed water demand is very elastic and likely to have a significant response to changes
in cost(pricing+taxation). Reclaimed water use changes significantly on other factors such as seasons and
weather conditions.The elastic nature of water consumption beyond basic essential uses(e.g. outdoor use and
reclaimed water) and lack of planning for implementation of this kind of tax heightens our concerns raised in the
second bullet.
I recommend the Clay County BCC fully evaluate these issues before instituting a utility tax on water use.
