Endevco of Jacksonville, LS26 EXECUTIVE SUMMARY AGENDA ITEM: Request for consideration and approval for Clay County Utility Authority ("CCUA")to purchase an easement from Endevco of Jacksonville,Inc. ("Endevco")for an existing lift station and gravity main located on Endevco's property at Blanding Blvd. and Youngerman Circle. Date: April 27, 2022 BACKGROUND: Staff requests Board's approval to purchase an easement for an existing lift station. The section of commercial property located at the southeast intersection of I-295 and Blanding Boulevard was developed nearly 40 years ago. Kingsley Service Company (KSC) approved the construction plans and secured a developer agreement for this commercial development with the previous developers. An easement over the onsite water and wastewater utilities and a wastewater lift station was designed and required to be conveyed to KSC. KSC accepted ownership and maintenance of the utilities and lift station; however, neither KSC nor the previous developers recorded the developer agreement in public records and no easement was secured by or conveyed to KSC. The current property owner of the lift station site, Endevco, recently contacted CCUA regarding -0 the potential redevelopment of the property. Endevco asked CCUA to relocate the existing lift a station facility or provide compensation for the lift station site and utilities that are on Endevco's cu property and outside of CCUA easements. The existing lift station site is shown on the attached o CCUA GIS Web Map and surveys. r c CCUA is requesting consideration and approval to purchase a 1,892 sq ft easement from Endevco cc for $20,000. The easement consists of a 38' x 58' (1,793 +/- sq ft) easement for the existing lift station site and a 40' x 26' easement(99 sq ft) easement for the 8-inch gravity wastewater main. Attached is a copy of an Easement Agreement executed by James Hogan, President of Endevco, detailing his agreement to grant CCUA the easement in exchange for the maximum total compensation of$20,000.00. Staff believes this is a reasonable request and value, as this easement is vital for CCUA to maintain wastewater service for the commercial developments in this area. Staff's recommendation to approve the purchase of the easement is based on the following considerations: • The existing lift station facility is an active lift station, and the cost to demo, relocate and maintain wastewater service to the customers serviced by the lift station would exceed $300,000.00. • Avoided costs for additional legal services, appraisal cost, and potential court cost. RECOMMENDATION: Staff respectfully recommends the Board of Supervisors approve the purchase of an easement from Endevco for $20,000.00, as reflected in the Easement Agreement. If approved, Jeremy D. Florida, Duval County, at Parcel No. 099094-0020. Dear Mr. Hogan: The Clay County Utility Authority (CCUA) is hereby requesting to purchase an easement, at the locations shown on the attached map. This will accommodate the existing lift station and wastewater mains. In exchange for your granting the to requested easement, CCUA proposes payment of$20,000.00. Payment will be issued at closing. CCUA will continue to maintain the lift station site and easement area. If any work is necessary in this area will be returned to at or near its pre-existing condition as reasonably practical, to include but not be limited to dressing up the construction area and removing all debris. This tentative agreement will then be presented to our Board of Supervisors for consideration, and a title search will be ordered.
