Good morning.Thank you for your email.
Our team remains actively engaged in pushing the contractor to complete this project per the approved plans and
specifications, remaining engaged in communicating with the homeowners, and documenting and sharing those
communications.
I agree with you that the contractor on this project has done a very poor job. I will not defend or justify their poor
performance. We are working diligently with the contractor to correct their work so that residents can get cost share
value for connection to the system. We understand that you are not trying to avail yourself of that value.

= You have been very clear to me since our first conversation about your opinions and that you have lost confidence in
CCUA and the contractor. In our April 18, 2022, telephone conversation,you stated that you do not see any

responsibility or accountability in this construction process. I will again clearly state there is responsibility and
L accountability through this process. As the Executive Director, I directed staff to follow the contract with the approved
3 plans and specifications.As part of those directions, CCUA is pursuing liquidated damages from the contractor due to
a)
the project delays. If the contractor delays lead to challenges with the plumbers, I intend on seeking legal remedies with
the contractor to address those issues.
While I can understand your frustrations with the project, CCUA has an obligation to follow through on the contracts we
engage in.The CCUA team continues to pressure the contractor through the means provided in the contract. I will not
authorize deviations from the contract without a proper change management process. I also will not authorize a course
of action that initiates potentially unnecessary and significant legal costs to CCUA, along with further time delays in
completing this project.
I do not agree with your continued statements that CCUA has shown poor support for the residents involved in this
project. I also have reports from our team documenting our interactions with the contractor and residents that do not
support your statements that our team is not communicating with residents. Our team has and continues to remain
available to answer questions. Our team has also sent letters and been available on-site to discuss the project with the
residents.
We look forward to the contractor completing their efforts on this project and getting the plumbers active in making the
connections for the residents participating in this project.

Mr. Sams,
We recently met when you came to the Windwood Project.You said if I had any concerns to contact
you.
On Monday morning I called the CCUA Engineer, Kevin Ledbetter, and asked what were the
requirements for backfill and compaction of the pipe trenches required by the specifications. He said
he did not know but would check the specs and email me. It has been three days and I have not
received any information from him.That afternoon the contractor came to my driveway trench to
to perform a density test. He dug down one foot and performed the test. It failed.
When the trench was dug it was very deep.The contractor backfilled it with unsuitable material and no
compaction. He told me when they were ready to pave they would dig the trench out and use the
proper fill material with compaction.This has not happened. No work has been done on Windwood
since Monday.
Also CCUA sent the residents on Windwood an email on Friday,
April 29th at 5:35 PM stating that paving would begin on Tuesday, May 2nd and sections of the road
would be restricted for thru traffic.This work was never started and the residents were not notified of
the cancellation. Many made plans to relocate their vehicles. Fortunately Mr. Matt King,the CCUA
Inspector, saw me on Monday and told be the paving was delayed a week because the system had
once again failed the pressure test.
These are just two very recent examples of CCUA's poor support for the residents involved in this
project. We have continually been given bad information and "lip service".
