BACKGROUND:
KBT Contracting Group commenced construction of the new Administrative Building Expansion Phase I.
After the contract was awarded to KBT Contracting Group, the Bhide and Hall Architects, P.A. (BHA),
needed to change the Engineer of Record(EOR)from Michelle Agee P.E.to Jones Edmunds and Associates
(JEA). The reason from the change in the EOR was due to Ms. Agee's passing. In taking over the EOR
responsibilities,JEA recommended changes to the stormwater conveyance design with the addition of pipe
and a storm structure. Because this change in the stormwater conveyance design was after the bid, KBT
Contracting is entitled to a change.
BHA and JEA completed design efforts without passing these design change costs to CCUA.However,the
design change does represent an increase in costs the contractor would be entitled to.BHA and staff agreed
the lump sum amount of$36,657.70 represented reasonable costs associated with the required resources

-a and materials to complete the work.

The Board of Supervisors previously authorized staff to approve change orders of$50,000 or 5% of the
° contract cost which ever is less. This direction from the Board of Supervisors is within Board meeting
c minutes, not within a readily available staff policy. Staff errored in already authorizing the change order
15 due to the change representing a 7% change in the contracted project costs. Staff requests ratification of
staffs action by the Board of Supervisors.
Staff will bring a formal update to the purchasing policy with the $50,000 or 5%requirements to prevent
such errors in the future.
Staff previously disclosed to the Board of Supervisors the current budget for the project. Staff had noted
Change Order No. 1 as a separate authorization. The project budget remains consistent with the previously
disclosed numbers.

Administrative Complex Expansion Budget: $5,125,089
Design and Bidding Services with BHA: $192,444.99
Construction Administrative Services with BHA: $93,071.60
Construction Services with KBT: $4,647,007
Sub-Total Design and Construction Services: $4,932,523.59
Project Contingency: $192,565.41
Physical Security Improvement Evaluation by BHA: $7,200

KBT (The Contractor) is providing construction services for the New Administration Building
Expansion and Site Improvements Project at the Old Jennings Road facility.
Change order 1 is the proposed amount associated with a Change in Scope due to revised civil
drawings from bid set. The change reflects additional RCP piping shown on drawings, the initial
design contained 122 LF and revised provides for 164 LF the delta is 42 LF of 24" RCP. An
additional structure ST-2 was added to plans and demolition of existing sidewalks were added to
the demolition plan.
to The demolition scope of sidewalk is appropriate when considering the existing sidewalk runs
under the new building footprint and the connection of new water service line to the east.

FOR has reviewed the proposal and responded with the following comments:
CO#1—Additional 48 LF of 24"RCP, additional Type "C"inlet(ST-2), and additional demo of
existing sidewalks is appropriate.
The Contractor submitted a change order request for a lump sum amount of $36,657.70 on
December 21, 2022 to perform the work described.The cost includes The Contractor's and their
subcontractors' costs with customary overhead and profit. CCUA staff entered negotiations with
KBT, and both parties have agreed to pursue a Change Order Request of$36,657.70 and extend
the contract time by 00 calendar days.
The negotiated lump sum amount represents reasonable costs associated with the required
resources and materials to complete the requested work.
