AGENDA ITEM:
Request for consideration and approval for the Clay County Utility Authority ("CCUA") to
purchase an easement from Brannan Mill Plantation Homeowner's Association for access in
conjunction with the construction of a CCUA north campus driveway.
BACKGROUND:
To address the safety concerns and to reduce any additional accident claims when entering or
exiting the existing CCUA campus driveways, staff engaged Jones-Edmunds last year to evaluate
three alternative driveway routes from the CCUA campus to the west via Brannan Mill Boulevard.
These three options were presented to the Board previously. The Board agreed with the
consultant's recommendation to move forward and authorized staff to begin discussions with the
affected parties including the need for an easement from Brannan Mill Plantation Homeowners
Association (BMP HOA) for the route west of the existing maintenance buildings which had the
lowest community and environmental impacts and was the most cost-effective.

c Staff met on several occasions with the BMP HOA to reach an agreement to grant the easement.
Attached is a copy of the executed Easement Agreement detailing the BMP HOA agreement for
granting the easement to CCUA in exchange for a payment of $37,534.43. Staff reviewed the
L compensation request against other construction and related fees associated with other route
options. This route remains the lowest cost, maintains the best relations with the neighborhood,
re and provides staff with the fastest ingress and egress on a safe route. Accordingly, the Staff
requests approval of the Easement Agreement, and authorization to proceed with closing the
easement, in accordance with the terms detailed in the Easement Agreement.
BUDGET:
The project is identified in CCUA's five (5) year Capital Projects Plan adopted by the Board of
Supervisors as the North Campus Driveway, with a total budget of$786,341.00. The remaining
budget includes sufficient funding to cover this easement.
RECOMMENDATION:
Staff respectfully recommends the Board of Supervisors' approval of CCUA's purchase of the
easement from Brannan Mill Plantation HOA for $37,534.43, plus ordinary, and reasonable
closing costs, expenses, and prorations.

Re: Request for your consideration in granting an easement to the Clay County Utility Authority
to accommodate a proposed new driveway on the property along Brannan Mill Road, at
Parcel No. 29-04-25-008068-003-21.
Dear Ms. Mitchell:
The Clay County Utility Authority (CCUA) is hereby requesting a 40-foot-wide easement adjacent
to Brannan Mill Road, at the location shown on the attached map, for a new driveway. The
IO easement will accommodate the implementation of the new driveway. In exchange for granting
the requested easement to CCUA, a copy of which is attached hereto, CCUA proposes payment of
$37,534.43 (Approx. 4,298 square feet +/-).
If this agreement is acceptable as presented, please sign in the spaces provided below and return
the signed original for processing.This tentative agreement will then be presented to CCUA's Board
of Supervisors for consideration, and a title search will be ordered. If approved by CCUA's Board of
Supervisors, and the title search confirms that there are no encumbrances on the property, CCUA
will prepare for closing. Any title issues must be resolved prior to closing.
