AGENDA ITEM:
Request for approval of an Easement Agreement and the Grant of Easement from Snooty Fox
Plaza, LLC, Mr. Bobby Mick, for an easement across the property at 4182 County Road 218, to
facilitate relocating the 12-inch water main and 12-inch gravity main as part of the Clay County
("County") County Road("C.R.")roadway widening project.

BACKGROUND:
CCUA entered an interlocal agreement with the County to participate in the County's roadway project
on CR 218. The agreement allows the County's engineer and contractor to perform the design and
construction for relocating CCUA utility mains within the work area that conflicts with the proposed
roadway improvements.The final design plans include the relocation of an existing 12-inch water main
and 12-gravity main located within the C.R. 218 right-of-way, which directly conflicts with the
proposed storm structure and roadway widening between Aster Avenue and Dolphin Avenue.The staff
has been working with the property owner,Bobby Mick,to secure a 25-foot easement to accommodate
the relocation of these mains, to be located in an easement along the southern portion of his
property.
Attached is a copy of the easement agreement staff has negotiated with Mr. Mick for a 25-foot
easement. In exchange for the easement, staff has agreed to provide four(4)water services,meters,
and connections equivalent to 1.75 ERC for water and one(1)wastewater stub for this commercial
building—a total credit of$6,174.43.
Staff believes the negotiated services, meters, and water connection credits of $6,174.43 as
compared to the current market value to purchase the 3,750 square foot easement at $2.50 per
square foot of$9,175.00 is in our best interest.
We believe this is a reasonable request and value per square foot, as this easement is vital to
complete the relocation of the water and gravity main in this area. We hereby request approval by
the Board for the Easement Agreement and Grant of Easement.
We seek authorization to proceed with the execution of the Grant of Easement and carry out the terms
detailed in the Easement Agreement.
BUDGET:
Staff budgeted a total of$675,000.00 for the CR 218 project in the FY 23-24 Capital Improvement Program
(CIP)budget.

Re: Request for your consideration in granting an easement to the Clay County Utility
Authority across your property at 4182 County Road 218, Middleburg, Florida.
Dear Property Owner:
The Clay County Utility Authority ("CCUA") is hereby requesting a 25-foot-wide easement
("Easement") across your property at the location shown on the attached map. The Easement
will accommodate the proposed construction along County Road 218. CCUA plans to relocate
the 12-inch water main within a 25-foot-wide perpetual easement across the southerly 25 feet of
your property, along with and abutting County Road 218. CCUA will restore your property to as
near its pre-existing condition as reasonably practical after construction of the mains, including
but not limited to restoration of fencing, removal of debris, and dressing up the construction area.
Existing deep-rooted trees located within the Easement during construction may be removed
during construction at CCUA's expense. The Easement will not transfer property ownership to
CCUA. You will still own and maintain the property where the requested Easement will be
located.
In exchange for your granting the requested Easement, CCUA hereby agrees to provide four(4)
water services, four (4) 5/8 x 3/4 meters, and one wastewater service stub for the building.
Services will be installed at an agreed-upon location along your property line, at CCUA's
expense, during the construction of the mains. Additional consideration of $787.50, equivalent
to the water connection fees for the 1.75 ERCs, based on the current tenant makeup in the
building. The existing well on the property must be capped and dismantled during the relocation
of water mains in this area. CCUA and the contractor will coordinate with you and/or your
plumber to minimize any interruptions in service.
If this request is acceptable, please sign in the space below and return the signed original for
processing. This tentative Agreement will be presented to CCUA's Board of Supervisors for
consideration.

Tyrone Road, Middleburg, Florida 32068, hereinafter called GRANTOR, and CLAY COUNTY
UTILITY AUTHORITY,an independent special district and political subdivision of the State of Florida,
existing and created under Chapter 94-491,Laws of Florida, Special Acts of 1994,whose business address
is 3176 Old Jennings Road, Middleburg, Florida 32068-3907, hereinafter called GRANTEE.
WITNESSETH: That GRANTOR, for and in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration to them in hand paid by GRANTEE, the receipt whereof is
hereby acknowledged, has granted, bargained, sold and conveyed to the GRANTEE, its successors and
assigns forever a non-exclusive right-of-way and easement with the right, privilege and authority to said
GRANTEE, its successors and assigns,to construct,operate, lay,remove,maintain, improve and/or repair
associated equipment for existing and future water, wastewater, and/or reclaimed water utilities owned by
GRANTEE, any or all, on, along, over, through, across or under the following described land, situate in

See Exhibit "A" attached hereto and by reference made a part hereof.
TOGETHER, with the right of said GRANTEE, its successors and assigns, of ingress and egress,
to and over said above described premises, and for doing anything necessary or useful or convenient or
removing at any time any and all of said improvements upon, over, under or in said lands, together also
with the right and easements, privileges and appurtenances in and to said land which may be required for
the enjoyment of the rights herein granted. GRANTOR does hereby fully warrant the title to the grant of
easement described herein, and will defend the same against the lawful claims of all persons whomsoever.
