HomeMy WebLinkAbout07.c EDB Easement Agreement w Reinhold Access Driveway EXECUTIVE SUMMARY AGENDA ITEM: Request for consideration and approval of the proposed Easement Agreement with Reinhold Corporation (Reinhold) to accommodate the utility transmission mains associated with the Peters Creek and Governor's Park Plant Projects along the East-West access driveway to Clay County Utility Authority's (CCUA) existing Peters Creek Wastewater Treatment Facility. Financial Job No. 22003SP Project No. 2211-0042 Date: March 1, 2024 BACKGROUND: Staff requests Board approval of this Easement Agreement. Upon approval, staff would move to close the easements in the area along the east-west access driveway to CCUA's existing Peters Creek Wastewater Treatment Facility. The easements in this agreement will accommodate the utility transmission mains being constructed between Rosemary Hill Road and the Peters Creek plant site. Staff requested an easement from Reinhold Corporation across their property near Rosemary Hill Road to the Peters Creek WRF Plant Site,as depicted on the attached map. We attached a copy of the executed Request for Consideration detailing the property owner's agreement to grant the CCUA the following: 0.54 acres in fee simple purchase, 1.26 acres of permanent easements,4.67 acres of temporary construction easements and converting 2.0 acres of existing temporary easements to permanent easements across their property. In consideration of these easements, Reinhold has agreed to a non-cash transaction, exchanging the land value credit for connection fees/charges totaling $354,232.00 or 59.6 Equivalent Residential Connections (ERC). This equals $1.04 per square foot for the 369,084 blended square feet of requested easements. Staff considers the request reasonable on a value-per-square-foot basis and consistent with other easements we have purchased. BUDGET: Reinhold agreed to a non-cash transaction, exchanging the land value credit for connection fees/charges of 59.6 Equivalent Residential Connections (ERCs). The current value to CCUA is $354,232.00. RECOMMENDATION: Staff requests approval of the Easement Agreement and authorization to proceed with closing the easements in accordance with the terms detailed in the Easement Agreement. Dear Mr. Egan: CCUA plans to extend utility infrastructure across Reinhold Corporation's property south of Rosemary Hill Road. To accommodate these extensions, CCUA requests 0.54 acres of fee simple purchase, 1.26 acres of permanent easement, 4.67 acres of temporary construction easements, and conversion of 2.0 acres of existing temporary easement to permanent easements across your property at the locations shown on the attached map. In return for granting CCUA the easements, CCUA would propose a land value credit toward connection fees/charges (inclusive of all capacity, supply, impact, and cost recovery charges for water, wastewater, and reclaimed) for 59.6 ERCs, available to you at closing. CCUA will restore your property to as near its pre-existing condition as reasonably possible, including but not limited to grading and grassing the construction area and removing all debris. No trees will be permitted to remain or be planted within the permanent easement areas. All utilities will be underground, except for fire hydrants and valve or meter boxes, which would be at or near ground level. If this agreement and the enclosed Grant of Easement and map are acceptable, please sign in the space provided and return the original to CCUA. Staff will then present this tentative agreement to CCUA's Board of Supervisors for consideration. If approved, staff will proceed with the title search, and if the title search confirms there are no encumbrances on the property, staff will prepare for closing. Any title issue must be resolved before closing. This may involve subordinations of mortgages or other releases, which you may be required to secure.
