CCUA Project No.: 4020-004 CCUA Financial Project Code: 21013AD Date: July 11, 2024 BACKGROUND: KBT Contracting Corporation (KBT) currently provides construction services for the New Administration Building Expansion and Site Improvements Project. KBT submitted a delay claim on May 30, 2024, requesting to add 159 calendar days to the contract. On June 27, 2024, KBT submitted a Schedule of Delay Time requesting 131 days. On July 11,2024, KBT subsequently submitted via email an updated Schedule of Delay Time, on KBT letterhead, restating 131 days of additional time needed due to delays. KBT indicates through the two documents adverse weather conditions and unexpected labor challenges affect KBT's project completion schedule. CCUA staff and Bhide & Hall Architects (BHA) reviewed the project schedule and contract and informed KBT they considered the labor and schedule challenges within contractor's control. However, CCUA staff and BHA can reasonably recommend 31 calendar days that KBT indicated were due to weather and muddy conditions post the rain events, which occurred between November 2023 and May 2024. KBT requests the Board of Supervisors consider the time beyond the 31 weather days to the full 131 calendar days in their Schedule of Delay Time per the latest document received July 11, 2024. Staff proposed Change Order No. 4 consists of adding 31 calendar days to the contract. This change order will not affect the contract price. Staffs recommendation is consistent with the terms and conditions of the contract. Should the Board of Supervisors approve KBT's request, Staff will update the proposed Change Order No. 4. RECOMMENDATION: Staff respectfully recommends the Board of Supervisors approve Change Order No.4 to the CCUA New Administration Building Expansion and Site Improvements Contract with KBT Contracting Corporation. FROM: Keith Timmons KBT Contracting Corp. RE: Clay County Utility Authority— Phase 1 Due to delays beyond our control, KBT Contracting Corp. requests an extension of time in the amount of 159 days. That would put the Substantial Completion date of 11/5/24 and the Final Contract Date of 11/20/24. The justification for the delay is purely a labor shortage issue in the construction industry. One example of a previous delay is the CMU/Bond Beam/Embeds: The original time frame was a total of 60 days. It took 89 days. The sub-contractors in all phases so far are working with fewer experienced workers in their labor force. Which translates into extended days in each phase. Therefore, KBT is requesting that 159 days be added to the contract. CGC 1520730/CBC058625/CCC 1330401 5105 Blanding Blvd. Jacksonville,Florida 32210 904/647-9200 Office SCHEDULE OF DELAY TIME 8-11-23 —Final Building Permit received- Remobilization initiated. 9-5-23 —Commenced work on footers (heavy rainfall). 9-12-23 —Rebar in footer submerged (drained and restarted). 9-14-23 —Footer reconstruction with gravel and plywood to prevent cave-ins. 9-26-23 —Footers poured post extensive rainfall. NOTE: The task, originally estimated to take 8 days, extended to 18 days due to adverse weather conditions and labor shortages. KBT had to repeatedly pump water out of the footers, remove the rebar, lay 12 inches of#57 stone and plywood forms, and then reinstall the rebar in the footers. This procedure led to a 10-workday extension of our project timeline. 10-4-23 —Removed forms from footers and began stem wall construction. We received 23 days (about 3 and a half weeks) added to the schedule for the above time frame. This is reflected in change order#3, approved by the board on 01/05/2024. 12-07-23 — Slab poured. 12-12-23 —Block work commenced. 01-04-24— Scaffolding delivered and erected. 04-12-24—Completion of CMU, Bond Beams, and Embeds. Note: The completion of this phase spanned five months due to the unexpected complexity and time demands that KBT experienced using two separate crews for this phase. A CMU crew and a concrete crew were utilized. The CMU crew handled the block and rebar uprights, while the concrete crew constructed the two 24-inch tie beams. Following the CMU crew's initial lift of a 4.5-foot wall, operations paused for county inspection before they could pour the cells and await a second inspection. This process repeated for subsequent lifts. The concrete crew then built the forms eight feet above ground and inserted a rebar cage for the first 24-inch tie beam, followed by inspection and pouring. After curing, they removed the forms and waited for the CMU crew to add another three to four courses of block/rebar, which was then inspected and filled. The concrete crew returned to construct the next 24-inch tie beam, now 12 feet high. Meanwhile, the CMU crew added two to three more courses, and the concrete crew completed the two cantilevered tie beams. S'I' CONTRACTING CORP. This has effectively extended this phase that was scheduled form 60 days to 150 days. These conditions led to 90-day extension of our project timeline. 04-29-24— Steel bar joists delivered. 06-03-24—Light Gauge trusses arrived. 06-19-24— Started assessment for remedial repairs. Notes: The total days, confirmed by daily logs on Procore and NOWData—NOAA Online Weather Data, indicate persistent rain and wet conditions have caused multiple complications from December to the present. KBT has lost a total of 31 workdays due to rain or muddy(un- workable) conditions that are included in the number of days requested to be added to the schedule. The total workdays lost due to these conditions is 31 days. The permit delays caused by the Clay County Building Department have led KBT to employ subcontractors with whom we have minimal to no prior experience. This has posed challenges that we are navigating through nearly all phases of this construction project. The total number of days lost to rain and the aforementioned issues is 131. (KBT) Job File No. 4020-004 Date: July 9, 2024 KBT (The Contractor) is providing construction services for the New Administration Building Expansion and Site Improvements Project at the Old Jennings Road facility. Change order 4 requests an additional 131 days added to the contract with no contract budget change. Bhide & Hall Architects, P.A. has reviewed the proposal and responds with the following comments: There are 3`Groups' of requested days reflected in KBT's timeline: 1. Rain delay days: 31 Days_- These days are due to poor site conditions due to rain. The contractor has provided adequate documentation for this, and we do not have an objection to their request to add these days to the contract. 2. Sub-Contractor Labor Shortages and Delays: 90 Days - There are days that KBT claims are related to challenges with the sub-contractor labor pool. Specifically, they have identified the masonry and concrete sub-contractor scope. KBT claims that the masons and concrete workers that provided labor for those efforts on the exterior walls did not provide the original teams that KBT expected when the project was bid. While this is not something that is identified in the contract as an acceptable delay claim (because it is a delay that should be within the contractors control to resolve), it could be reasonable to assume this has caused them delays. We have recommended to CCUA staff that KBT explain the masonry delays to CCUA to receive a final response on the claim. a. In our opinion, the labor issues that KBT has explained are an understandable challenge. We have witnessed struggles in the labor market, especially in the masonry field. This could explain why the process has taken KBT longer than originally planned. 3. Additional delay days that were not previously requested: 10 Days - KBT claims they never requested 10 days as a part of the first Change Order for Rain delays. AR0091953 working the footings that were washed out as a part of heavy rains back in October- November 2023. The claim is that rain caused the formwork to wash out in some areas and additional rock and shoring had to occur before the footings could be poured. The labor that should have arrived to repair the problems, came in sporadically from the sub- contractor) and was limited. KBT claims that there were 10 additional days that they did not request in the previous change order because they were hopeful to make this up during the remainder of the project timeline. We have recommended to CCUA staff that KBT explain the masonry delays to CCUA to receive a final response on the claim. Bhide & Hall Architects, P.A. recommendation is to accept the 31 days that have been presented for rain delays and adverse conditions. Acceptance of additional days as requested by the contractor can be determined by the Board. BUDGET: The project construction budget with Proposed Change Order No. 4 accepted will remain unchanged at $4,712,909.99.
