HomeMy WebLinkAbout09.a LB 2024-2025-04 Rate Resolution Amendment CLAY COUNTY UTILITY AUTHORITY RESOLUTION NO. 2024/2025-04 A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE CLAY COUNTY UTILITY AUTHORITY AMENDING RESOLUTION NO. 2024/2025-01; SUBSTITUTING CORRECTED EXHIBIT "A" TO RATE RESOLUTION RE SCHEDULE OF ADOPTED RATES, FEES, AND CHARGES TO RATE RESOLUTION FOR FISCAL YEAR 2024/2025; SUBSTITUTED EXHIBIT "A" TO BE THE EXCLUSIVE VERSION REFERRED TO AS A DEFINED TERM IN SECTION 2(23) OF THE RATE RESOLUTION; PROVIDING AN EFFECTIVE DATE. WHEREAS, on October 1, 2024, the Board of Supervisors ("Board") of Clay County Utility Authority (hereinafter, the "Authority" or "Utility"), an independent special district of the State of Florida, adopted its annual Rate Resolution and Service Availability Policy, together with exhibits and attachments thereto, to establish, among other things, the operative rates, fees, and charges for the Utility for its Fiscal Year 2024/2025, designated as Resolution No. 2024/2025-01 (the "Rate Resolution"), with an effective date of October 1, 2024; WHEREAS, Exhibit "A", in the form as attached to the Rate Resolution as formally adopted by the Board on October 1, 2024, was in fact a prior preliminary version of that schedule of rates, fees, and charges, and did not reflect the final schedule of reduced rates, fees, and charges which were (i) addressed at the Authority's annual public rate hearing on September 10, 2024, and (ii) subsequently approved by informal action of the Board, as Item No. 10.b., at the Authority's regular scheduled Board meeting on September 17, 2024; and WHEREAS, it is therefore necessary, appropriate, and helpful to the overall mission and goals of the Authority to substitute the attached, corrected Exhibit "A" to the Rate Resolution, to accurately reflect the understanding and expectation of the Utility, Board, and ratepayers, and to be consistent with the prior action of the Board as to such rates, fees, and charges, and the adopted budgets for Fiscal Year 2024/2025, to be effective as of October 1, 2024. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE CLAY COUNTY UTILITY AUTHORITY, an independent special district created and existing under Chapter 94-491, Laws of Florida, Special Acts of 1994, as follows: Section 1. The Board does hereby formally substitute as Exhibit "A" to the Rate Resolution the attached schedule of rates, fees, and charges for the Utility for Fiscal Year 2024/2025, in the form as attached hereto as Exhibit "A" and hereby incorporated by this reference. Section 2. Exhibit "A" hereto shall therefore supersede and replace the prior version of said exhibit to the Rate Resolution, and this corrected version of Exhibit "A" shall be the treated exclusively as the defined term identified and referenced as Exhibit "A" in SECTION 2(23) of the Rate Resolution. Section 3.
