BETWEEN BANK OF AMERICA, NATIONAL ASSOCIATION, a national banking association,
whose mailing address is 100 N. Tryon Street, Mail Code NC1-007-25-50, Charlotte, North Carolina
28255, Attn: Property ID: FL8-026, hereinafter called GRANTOR, and CLAY COUNTY UTILITY
AUTHORITY, an independent special district existing and created under Chapter 94-491, Laws of
Florida, Special Acts of 1994,whose business address is 3176 Old Jennings Road, Middleburg,Florida
32068-3907, hereinafter called GRANTEE.
WITNESSETH: That GRANTOR, for and in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration to it in hand paid by GRANTEE, the receipt whereof is
hereby acknowledged, has granted, bargained, sold and conveyed to the GRANTEE, its successors and
assigns a non-exclusive Temporary Construction Easement for the purpose of providing additional
workspace for the construction of water facilities, including but not limited to a bore pit, associated with
a water main extension, project to be undertaken by GRANTEE, its successors and assigns, said
Temporary Construction Easement being located across or under the following parcel of land, situate in
Clay County, Florida, to-wit:
See EXHIBIT "A", attached hereto and by reference made a part hereof.
Such area is referred herein as the "TCE Area."
If GRANTEE causes any damage to GRANTOR's property, GRANTEE shall, at GRANTEE's
sole cost and expense, promptly and fully repair and restore the ground surface and any improvements
located on GRANTOR's property, whether within the TCE Area or otherwise, to approximately the
same condition as said ground surface and improvements existed prior to such damage, as is reasonably
practical under the circumstances.
This Temporary Construction Easement shall automatically terminate on April 01, 2026.
TOGETHER,with the right of said GRANTEE,its successors and assigns,of ingress and egress,
to and over said above-described premises, and for doing anything necessary or useful or convenient
upon, over or under the Temporary Construction Easement, together also with the right and easements,
privileges and appurtenances in and to said land which may be required for the enjoyment of the rights
herein granted, provided that in no event shall GRANTEE allow any vehicles, equipment, or materials
to remain within the TCE Area overnight or when GRANTEE is not using the TCE Area. To the extent
possible, GRANTEE shall notify GRANTOR prior to commencing GRANTEE's use of the TCE Area
pursuant to this Temporary Construction Easement.
