WITNESSETH: That GRANTOR, for and in consideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration to them in hand paid by GRANTEE, the receipt whereof is hereby acknowledged, has granted, bargained, sold and conveyed to the GRANTEE, its successors and assigns forever a non-exclusive right-of-way and easement with the right, privilege and authority to said GRANTEE, its successors and assigns,to construct,operate, lay,remove,maintain,improve and/or repair associated equipment for existing and future water,wastewater, and/or reclaimed water utilities owned by GRANTEE, any or all, on, along, over, through, across or under the following described land, situate in Clay County, Florida, to-wit: • See Exhibit "A" attached hereto and by reference made a part hereof. GRANTEE shall restore the easement area to as near its pre-existing condition as reasonably practical following the construction improvements within the above-described easement area for the purposes set forth herein. This Temporary Construction Easement shall automatically terminate upon completion of said public utility project, but no later than April 01, 2026. TOGETHER, with the right of said GRANTEE, its successors and assigns, of ingress and egress, to and over said above described premises, and for doing anything necessary or useful or convenient or removing at any time any and all of said improvements upon, over, under or in said lands, together also with the right and easements, privileges and appurtenances in and to said land which may be required for the enjoyment of the rights herein granted. GRANTOR does hereby fully warrant the title to the grant of easement described herein and will defend the same against the lawful claims of all persons whomsoever. (Clay County Parcel No. 37-05-24-006797-001-00) Dear Mr. Quimby: Following up on our phone conversation, the CCUA is hereby requesting a 15-foot-wide • permanent easement ("Easement") - and a 10-foot=wide temporary easement ("Temp. Easement") across your property at the locations shown on the attached map. The Easements . will accommodate CCUA's project to extend a 12-inch water main enhancing system redundancy for the Middleburg area. The 12-inch water main will be installed within the 15-foot- wide perpetual easement across the easterly 15 feet of your property, along and abutting Blanding Boulevard. The 10-foot-wide temporary. easement will be utilized during the construction period only and will .automatically: terminate upon project completion. CCUA will restore your property to as near its pre-existing condition as reasonably practical after construction. If any, existing deep-rooted trees located within the Easement during construction may be removed during• construction at CCUA's expense. The Easement Will not transfer • property ownership to CCUA. You will still own and maintain the property where the requested Easement will be located. In consideration of your granting the easement, CCUA hereby agrees to provide one 2- inch water service at an agreed-upon location along your property line during the construction of the 12-inch water main extension project. Additionally, CCUA will install_one wastewater . service when and if wastewater infrastructure is extended to this area. When you or the future property owner is ready to make connection to CCUA's water and/or wastewater systems, you • would be responsible for the current rates, fees and charges associated with the intended use . of the property. In regard to your request to allow the placement of a monument sign within in the proposed 15' CCUA Easement fronting Blanding Boulevard: While CCUA is open to considering the placement of a sign within the easement, any use must not impede our ability to access and maintain our infrastructure. To proceed, we would need to review the proposed sign design and location to ensure there are no direct conflicts with our facilities or maintenance requirements. Once you or any future property owner has finalized a design and identified a preferred location, please submit the details for our review and consideration., If the terms and conditions outlined in this letter are acceptable, please sign below and • return the signed original. This tentative agreement will then be presented to CCUA's Board of Supervisors for review and final consideration.
