EXECUTIVE SUMMARY AGENDA ITEM: Approval of Easement Agreement with Mr. and Mrs. Zambito (Parcel No. 17-04-25-007950-005- 02)—Green Oaks Lane&Challenger Drive and authorization for the Executive Director to execute and record all associated documents. Date: September 4, 2025 Staff is requesting that the Board(1)approve the Easement Agreement with Mr. and Mrs.Zambito, (2) authorize the Executive Director (or designee) to execute and record the easement and any ancillary documents, and(3)approve a not-to-exceed amount of$14,000.00 for consideration and closing costs. BACKGROUND: CCUA has initiated the installation of approximately 4,000 linear feet of new 12-inch water main along Green Oaks Lane and Challenger Drive to create a looped distribution system.This easement enables the final phase needed to close the loop,improving system reliability, stabilizing pressures, enhancing fire flow, and providing redundancy during maintenance or unexpected outages. To construct and maintain a segment of this improvement, CCUA requires a perpetual utility easement across the property of Mr. and Mrs. Zambito (Parcel No. 17-04-25-007950-005-02). Location Green Oaks Lane and Challenger Drive corridor; easement area traversing the Zambito parcel identified above. (See attached location map and Exhibit A—legal description and sketch.) Key Terms • Type: Perpetual, non-exclusive utility easement(with rights of ingress/egress for installation, operation, maintenance, repair, replacement, and upgrades). • Width/Area:10 feet wide/approx. 3,727 sq ft • Compensation: $12,500.00 plus recording and customary closing costs. • Restoration: CCUA will restore disturbed areas to equal or better conditions, subject to reasonable construction tolerances. Budget The existing capital project budget for the final phase of the Challenger Drive water main extension/looping project includes sufficient funds for easement acquisition costs (compensation, recording, and closing costs). The total costs for this easement acquisition are not expected to exceed $14,000. //MB(Author) //MB/DD(Review) //DD (Final) Schedule Upon Board approval, staff will finalize signatures and record the easement. Construction activities within the easement are anticipated to proceed in accordance with the project schedule Q 1 FY 2025/2026. RECOMMENDATION: Staff respectfully recommends that the Board approve the Easement Agreement with Mr. and Mrs. Zambito and authorize the Executive Director to execute and record the easement and any ancillary documents necessary to complete the transaction. The Easement will accommodate our water main extension to create a looped water system. This will improve reliability and ensure a consistent water supply by providing redundancy in case of maintenance or unexpected outages CCUA will restore your property to as near its pre-existing condition as reasonably practical after the construction of the services, including but not limited to removing debris and dressing up the construction area. Existing deep-rooted trees located within the Easement during construction may be removed during construction at our expense The Easement will not transfer property ownership to CCUA. You will still own and maintain the property where the requested Easement will be located In exchange for your granting the requested Easement valued at $12,500.00 (10 x 372 7' = 3.727 square feet x $3.35), I have enclosed a copy of a sketch and the proposed Grant of Easement document for your review so that you know exactly what we are asking you to consider If this agreement is acceptable. please sign in the space below and return the original to us.
