HomeMy WebLinkAbout10.e EDB Property Acquisition – 2886 Robinette Drive EXECUTIVE SUMMARY AGENDA ITEM: Request for Consideration and Approval of Property Acquisition—2886 Robinette Drive Clay County Utility Authority("CCUA")requests consideration and approval to acquire an approximately 0.126-acre vacant parcel located at 2886 Robinette Drive, Orange Park, Florida(Clay County Parcel No. 42-04-26-013266-000-00)to secure and protect existing CCUA wastewater infrastructure. Date: March 6, 2026 BACKGROUND: Staff requests that the Board of Supervisors authorize the Executive Director to proceed with the purchase of a 0.126-acre vacant parcel to secure and protect CCUA's existing wastewater infrastructure, which includes an 8-inch gravity wastewater main and manhole, currently located on the property. Approval will also authorize reimbursement to the property owner for reasonable costs incurred to date associated with survey,permitting, and related activities tied to the parcel. On January 29, 2026, CCUA was notified that during clearing and grading activities associated with the construction of a new residential home, the contractor encountered an existing CCUA manhole located within the subject parcel. Subsequent review of CCUA records and field verification confirmed that an existing 8-inch gravity wastewater main and associated manhole traverse the property. The parcel is privately owned and was being prepared for the development of a single residential home. Following the notification, CCUA staff conducted a review and evaluation of potential options to resolve the conflict between the planned development and the existing wastewater infrastructure. One option considered was the relocation of the existing gravity wastewater main to accommodate the proposed construction. Preliminary analysis determined that relocation of this gravity main would require significant engineering design, permitting, and construction, including potential impacts to adjacent properties and restoration of disturbed areas. Based on initial estimates,the cost to relocate the infrastructure substantially exceeds the property owner's proposed purchase price for the parcel, even when considering costs the property owner has already incurred for surveying, permitting, and site preparation. Based on this analysis, acquisition of the parcel represents the most cost-effective and operationally responsible solution. Ownership of the parcel will allow CCUA to: • Protect and maintain the existing 8-inch gravity wastewater main and manholes. • Ensure unrestricted access for maintenance, repair, and future replacement activities. • Prevent future conflicts between utility infrastructure and private development. • Avoid the substantially higher costs associated with relocating the existing wastewater main. The total acquisition cost will include the negotiated purchase price of the 0.126-acre parcel and reimbursement of reasonable costs incurred to date by the property owner related to survey, permitting, and associated activities. STAFF RECOMMENDATION: Staff respectfully recommends that the Board of Supervisors approve the attached Letter of Intent and authorize the Executive Director to proceed with the acquisition of the property located at 2886 Robinette Drive, consisting of approximately 0.126 acres, for a purchase price of$75,000.00, plus any associated closing costs. Staff further recommends authorizing the Executive Director to execute the Purchase and Sale Agreement and any additional documents necessary to complete the transaction. Acquisition of the property represents the most practical, cost-effective, and least disruptive solution to secure and protect CCUA's existing 8-inch gravity wastewater infrastructure and associated manhole located on the parcel and ensure continued operation and maintenance access. Based on discussions with you and the documentation you provided,CCUA intends to purchase the Property for a total purchase price of Seventy-Five Thousand Dollars ($75,000.00). The proposed transaction is subject to the following general terms: 1. Purchase Agreement: The parties will enter into a mutually acceptable Purchase and Sale Agreement prepared by CCUA's legal counsel. 2. Closing: Closing shall occur on a mutually agreed upon date following execution of the Purchase and Sale Agreement and completion of standard closing requirements. 3. Title: The conveyance shall be by Warranty Deed,free and clear of all liens and encumbrances, except those acceptable to CCUA. CCUA reserves the right to obtain a title commitment and perform customary due diligence prior to closing. 4. Closing Costs: CCUA will be responsible for customary closing costs associated with the purchase, including recording of the deed. 5. Access and Coordination: The parties will reasonably cooperate to facilitate inspections, title review, and closing preparations. This Letter of Intent is provided only to outline the parties'preliminary understanding and does not constitute a binding agreement for the purchase and sale of the property. The transaction will proceed only if a formal written Purchase and Sale Agreement is executed by both parties and approved in accordance with CCUA's required procedures.
