CLAY COUNTY UTILITY AUTHORITY
June 7, 2026
The Board of Supervisors of the Clay County Utility Authority (CCUA) met in Regular Session in the Board
meeting room at the Administrative Office of the Clay County Utility Authority, 3176 Old Jennings Road,
Middleburg, Florida, on the above-stated date.
Item No. 1 —Call to Order
Chairman McNees called the meeting to order at 2:01 P.M.
Item No. 2—Invocation/Pledge of Allegiance
Ms. Lebesch offered the Invocation and led those in attendance in the Pledge of Allegiance.
Item No. 3—Roll Call
Roll Call was taken with Chairman McNees, Vice-Chairman Petty, Mr. Bourre, Mr. Hingst, Ms. Lebesch, Mr.
McCall, and Mrs. Taylor in attendance.
Also present at the meeting were Executive Director Jeremy Johnston, Chief Operations Officer Darryl Muse, Chief

After discussion, Mr. Bourre moved, seconded by Mr. Hingst, and carried 7-0, to approve the minutes of the
Regular Meeting held on June 16,2026, as amended.

Item No. 7—Business discussed at committee meetings—July 7, 2026, Joint Budget Committee Meeting
Audit/Finance Committee Chairman Petty reported members of the Audit/Finance and Personnel Committee
met at noon prior to today's meeting to review and discuss the proposed 2026/2027 Fiscal Year Budget. After
discussion, upon recommendation from the Audit/Finance and Personnel Committee meeting the motion carried
7-0, to tentatively approve the proposed 2026/2027 Fiscal Year Budget for advertisement and publication, as
presented.
Item No. 8—Executive Director's Business
a. May 2026 Financial Package
Chief Financial Officer Karen Osbourne presented the Financial Statements for May 2026 and reported
Operating Income is $2,579,112 (17%) over budget due to unfavorable revenue and a favorable expense
variance. Operating Revenue is $281,336 (0.6%)under budget and Operating Expenses are $2,860,448 (8%)
under budget. CCUA has gained 795 active water accounts and 794 active sewer accounts during fiscal year
2025/2026. After discussion, Mrs. Taylor moved, seconded by Mr. McCall, and carried 7-0, to accept the
Financial Statements for May 2026, as presented by Ms. Osbourne.
b. Approval of the Right of First Refusal Agreement - Peters Creek Water Reclamation Facility Expansion
Property
Development Service Manager Melisa Blaney presented for approval of a Right of First Refusal Agreement-
Peters Creek Water Reclamation Facility Expansion Property. Staff is planning for the long-term
expansion of the Peters Creek Water Reclamation Facility (PCWRF) to accommodate projected
wastewater demands within the Peters Creek service area. Master planning identified the need for
approximately thirty (30) acres of adjacent property to support the phased expansion of the facility from
its existing capacity of 1.5 million gallons per day (MGD) to an ultimate buildout of 10.0 MGD. The
property identified for future expansion is currently owned by the Reinhold Corporation and Klare
Timber, LLC and is subject to an active purchase agreement with another party. While CCUA initially
pursued acquisition of the property, the owner has indicated they are not prepared to proceed with a sale
at this time due to ongoing planning associated with the proposed Peters Creek Business Park. As the
final layout and development footprint of the business park may change, the owner wishes to retain
ownership until those plans are further defined. To preserve CCUA's opportunity to acquire this
strategically located property in the future, staff negotiated a two-year Right of First Refusal (ROFR)
Agreement. Under the agreement, if the owner elects to sell the property during the two-year term,
CCUA will have the first opportunity to purchase the identified expansion area by matching the terms of
a bona fide third-party offer. The agreement also provides flexibility for the final acquisition area to be
adjusted by mutual agreement, to accommodate future business park planning while ensuring the
property remains adjacent to the existing treatment facility. Approval of the ROFR will protect CCUA's
long-term planning interests by preserving the opportunity to secure property necessary for future

expansion of the PCWRF without requiring an immediate property purchase. After discussion, Mrs.
Taylor moved, seconded by Mr. McCall, and carried, 7-0, to authorize the Executive Director to execute
the agreement, as presented.
c. Customer Service Training Manual&Billing SOP Presentation
Customer Service & Billing Manager Diana Strickland provided a presentation regarding CCUA's Customer
Service Training Manual & Billing Standard Operating Procedures. This report was for the Board's
information only; no action was requested or required.
d. Professional Development and Training Program Presentation
Human Resource Generalist 1 Summer Berndt provided a presentation on the status of CCUA's Professional
Development and Training Program. This report was for the Board's information only; no action was
requested or required.
e. Other
Executive Director Jeremy Johnston shared the Rate Study, a Legislative brief, and a report on the Biosolids
Study will be presented at future meetings.

Mr. Williams shared a Motion to Dismiss Plaintiff's Complaint has been submitted on Case Number
2026CA000319,which was filed against the CCUA by the Glenhaven Homeowners Association, Inc.
