for incorporation into CCUA's annual resolutions which will have an effective date of October 1, 2026,
as presented.
b. Approval of Updates to Clay County Utility Authority's Service Availability Policy to incorporate
provision for private grinder pump/lift stations
Development Services Manager Melisa Blaney presented for approval proposed updates to Clay County
Utility Authority's Service Availability Policy to incorporate provision for private grinder pump/lift
stations. Staff annually reviews and adopts its Rate Resolution and associated policies to establish the
rates, fees, charges, and terms and conditions governing utility service for the upcoming fiscal year. As
part of the annual review, staff is proposing updates to the Service Availability Policy to clarify and
formally document current procedures related to private wastewater pump/lift stations. The proposed
revisions establish clear requirements for developments requesting approval to install a private lift
station to serve their project, including responsibility for ownership and maintenance, regulatory
compliance, and associated financial obligations. Under the proposed provisions, private pump/lift
stations would be limited to serving developments under common ownership where the facilities remain
privately owned, operated, and maintained by a single responsible property owner or legal entity.
Developments consisting of multiple separately owned fee-simple parcels or lots would be required to
construct the lift station and associated facilities with CCUA standards for dedication to CCUA. The
proposed revisions are intended to provide consistent requirements for Developers while mitigating
CCUA's operational and financial liability associated with privately owned wastewater infrastructure. In
multi-owner or multi-business developments, inadequate maintenance, system failure, or regulatory
noncompliance could disrupt wastewater service to properties that do not own or control the private
infrastructure necessary to maintain service. Requiring applicable facilities to be dedicated to CCUA
provides consistent operation, maintenance, and regulatory oversight and reduces the risk of service
interruptions resulting from a private property owner's or association's failure to maintain critical
wastewater infrastructure. Staff is requesting tentative approval which will allow them to incorporate the
proposed provisions into the final Service Availability Policy for formal consideration and adoption by
the Board at the October 6, 2026, meeting. Upon formal adoption, the revised policy provisions are
proposed to become effective October 1, 2026. After discussion, Mrs. Taylor moved, seconded by Mr.
Hingst, and carried 6-0, to grant tentative approval for incorporation into CCUA's Service Availability
Policy with an effective date of October 1, 2026.
