As required by Florida Statute, staff disclosed the proposal at the October 6, 2026, Board of Supervisors meeting. Staff seeks approval from the Board of Supervisors to negotiate an agreement with Mack for the implementation of the unsolicited proposal. BACKGROUND: Staff has been working on a path forward to address treatment capacity needs in the Keystone Heights area economically and within CCNA limits previously stated to the Board of Supervisors. CCUA operates and maintains the Keystone Heights WRF that serves predominantly commercial customers in the Keystone Heights service area. Staff worked with a consultant to develop a design for the expansion of the Keystone Heights WRF from 0.074 to 0.200 MGD. As staff disclosed on April 1, 2025, we expected the construction of the Keystone Heights WRF to be within the CCNA limits of$7.5M. In June 2026, we informed the Board of Supervisors that the Engineer of Record's Opinion of Probable Construction Cost of the final design exceeded $9.1M. Based upon this cost disparity, staff began researching other economical alternatives and approaches to the Keystone Heights WRF design. At the October 6, 2026, Board of Supervisors meeting, staff disclosed receipt of an unsolicited proposal from Mack to design, permit, and construct a new 0.350 MGD WRF (Project). Unsolicited proposals from a private entity and a Responsible Public Entity (RPE) are regulated by F.S.S. 255.065 (Statute). CCUA has reviewed the Statute and determined the Project to be a qualifying project. Further, the Statute requires an RPE to consider the factors established in 255.065(3)(c) in making the determination that a qualifying project is in the public interest. Those factors are: 1. The benefits to the public. 2. The financial structure of and the economic efficiencies achieved by the proposal. 3. The qualifications and experience of the private entity that submitted the proposal and such entity's ability to perform the project. 4. The project's compatibility with regional infrastructure plans. 5. Public comments submitted at duly noticed public meetings. //DP(Author) //JP,AE(Review) //DD (Final) CCUA staff, including Procurement, Engineering, Operations, and Finance, considered those factors and determined that the Project is in the public interest. With that determination, the Statute authorizes an RPE to proceed with the unsolicited proposal. The Project benefits the public by satisfying existing demand for treatment capacity with an entirely new facility. The facility will be capable of serving potential projected growth through 2050 including regional infrastructure plans such as expansion of the Keystone Heights Airport and septic-to-sewer conversion projects. The economic efficiencies include adding capacity for $22.71 per gallon of treatment capacity ($4,542.86/ERC) as opposed to $72.41 per added gallon of capacity ($14,482 /ERC). The lower cost alternative considered here aligns more closely with CCUA's current sewer capacity charge, $4,528.20 / ERC. Additionally, the Project utilizes a process and equipment nearly identical to that used at CCUA's other facilities. Mack Industries started as a precast concrete product provider and has been in business since 1932. They have expanded to include construction and maintenance services for wastewater and stormwater treatment. Mack currently operates in thirteen (13) states and has successfully built similar plants including one recently completed for the Melrose School District. CCUA staff will ensure the capability of the firm to meet our standard bonding and insurance requirements before recommending execution of a contract with the company. Finally, an RPE must provide the public an opportunity to comment at two (2)duly noticed public meetings. The Project was introduced and disclosed at the October 6, 2026, Board of Supervisors meeting and there were no public comments. The October 20,2026,Board of Supervisors meeting will be the second public meeting at which members of the public will have the opportunity to comment on the Project. BUDGET: The FY 26/27 adopted budget includes $10,955,021 for the Keystone Heights WWTF expansion. The budget has sufficient funds to complete the Project including the 10% contingency required by the CIP Performance Management Policy. CCNA: This unsolicited proposal centers on the delivery of a fully constructed facility, and is not classified as a solicitation for professional services. RECOMMENDATION: Staff respectfully request the Board of Supervisors authorization to negotiate an agreement with Mack Industries for the services specified in the attached unsolicited proposal in the amount of $7,950,000. Staff will return to the Board for authorization to execute a contract for the final negotiated scope and fee.
